Client or user information will be handled in accordance with our Privacy Policy and any applicable client agreement. Use of such tools does not change the purpose for which information is collected, and 28Lions does not sell submitted business information to advertisers.

Submission of information through the Site does not obligate 28Lions to accept you as a client, begin work, or continue communications.

6. Account and Credential Security

If any portion of the Site permits account creation, portal access, logins, or password-protected areas, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

18. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, FEATURES, MATERIALS, AND FUNCTIONALITY PROVIDED THROUGH IT ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

28Lions disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and freedom from harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, 28LIONS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, 28LIONS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US THROUGH THE SITE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

20. Release

To the fullest extent permitted by law, if you have a dispute with one or more third parties arising out of your use of the Site, you release 28Lions and its owners, officers, employees, contractors, agents, affiliates, licensors, and representatives from claims, demands, and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such dispute.

You agree to defend, indemnify, and hold harmless 28Lions and its owners, officers, employees, contractors, affiliates, agents, licensors, and representatives from and against any and all claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your use of the Site;
• your Submissions;
• your violation of these Terms;
• your violation of any law;
• your infringement or violation of any third-party right.

22. U.S. Operation and Foreign Access

The Site is controlled, operated, and administered from the United States. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws to the extent they apply.

You agree not to use the Site or any Site content in any country or in any manner prohibited by applicable law, restrictions, or regulations.

23. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any claim, action, or dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state courts located in Miami-Dade County, Florida, or the applicable federal court having jurisdiction there, and you consent to that jurisdiction and venue.

24. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim or cause of action arising out of or relating to the Site or these Terms must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

25. Waiver and Severability

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, restructuring, reorganization, or by operation of law.

These Terms, together with any policies or additional terms expressly incorporated by reference, constitute the entire agreement between you and 28Lions regarding your use of the Site.

28. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms by posting a revised version on the Site. The updated Terms will be effective as of the “Last Updated” date shown above unless otherwise stated.

Your continued use of the Site after revised Terms are posted constitutes your acceptance of the updated Terms.
